Property & Financial Matters

When couples separate they need to divide the property and finances they have acquired during their relationship. Property can include real estate, monies in bank accounts, businesses, shares , companies, trusts, motor vehicles, furniture and effects and superannuation.

  • The Courts takes a four step approach when determining the division of matrimonial assets as follows:
  • Determining the net asset pool, that is the value of your assets less the value of your liabilities;
  • Assessing the contributions, both financial and non-financial, that each of the parties made during the relationship;
  • Assessing the future needs of each of the parties;
  • Ensuring that the overall result is both just and equitable.

Property and financial proceedings must be commenced within twelve months of the date of the Divorce. In De facto relationships matters proceedings must be commenced within two years of the date of separation.

Our aim is to negotiate a fair and equitable property settlement for you without the need to go to Court. However in some circumstances issues in dispute can not be resolved and proceedings must be commenced.
